Assault with blood case goes to court

A Kane man who allegedly sprayed his blood in the direction of a State Police trooper is headed to McKean County Court on an assault charge.

Michael Daniel Johnson, 38, of 6588 Route 321 South was charged with simple assault after the alleged incident Oct. 5 in the emergency room at Kane Community Hospital.

After a recent preliminary hearing before District Judge Michael Kennedy of Kane, charges against the defendant were bound over to county court.

According to court information, Brookville attorney Robbie Martin Taylor represented Johnson at the hearing. County District Attorney John Pavlock was the prosecutor at the hearing.

State Police Trooper Timothy Lencer charged Johnson with driving under the influence (DUI) of alcohol and four other traffic law violations in addition to assault.

According to court records, Johnson was transported to the hospital by ambulance following a one-vehicle accident on Old Settlement Road, a half of a mile north of Route 321 in Wetmore Township.

As Trooper Lencer was interviewing the defendant at the hospital, Johnson allegedly “pulled the dressing off his nose,” court records show. Johnson allegedly sprayed blood in the direction of the police officer and said “here, you want some blood, here’s some blood,” court documents indicate.

Trooper Lencer said the blood spray missed him, but hit a clipboard he was holding, according to court information.

When Trooper Lencer spoke with Johnson at the scene of the vehicle rollover, the defendant claimed someone else was driving, court documents show. However, a police investigation found “no evidence” to show that another person had been driving the vehicle, according to court records.

Johnson allegedly sustained a laceration to the side of his nose in the accident and went to the hospital after treatment at the scene, court records show. Johnson declined to take a blood test to determine his blood alcohol content (BAC), court documents indicate.
